This affirmation is required by Section 6254.2 of the Government Code. I hav

e requested access to information submitted to the Department of Pesticide Regulation (or previously submitted to the Department of Food and Agriculture) by a pesticide applicant or registrant pursuant to the California Food and Agricultural Code.

It seems that Govt Code 6254 (f) allows a "victim" to obtain a copy of the p

olice report, etc (whereas seemingly the accused/arrestee would be barred from receiving a copy of the police report {not sure why})...QUESTION: If a case is rejected on its face by the D.A. (without further investigation for insufficient evidence), is the "victim" still technically considered a "victim"??

Section 6254 (f), widely known as the “Investigatory Privilege,” is the

most common exemption from the disclosure of law enforcement records under the CPRA. However, this isn’t an absolute privilege. Not all information maintained by a law enforcement agency is exempt from disclosure under section 6254 (f).

The Act sets out a long list of specific exemptions (Cal. Gov't Code § 6254

), including: Preliminary drafts, notes or memoranda.

o anyone for any purpose. On July 1, 1996, however, California Government Code § 6254(f) was amended to prohibit the release of arrestee addresses to people who intend to use those addresses for commercial purposes.

Section 6254, in the course of 26 separate subdivisions, sets forth many of
