(a) Evidence that a person has, in compromise or from humanitarian motives

Evidence Code section 1152 exists to ensure that civil case litigants can sa

fely have the discussions that settle financial disputes of many flavors.

a at least, writing the words “privileged and confidential settlement communication” does not make it so. California Evidence Code §1152 provides confidentiality protection in settlement discussions:

In summary, Evidence Code §§1152 and 1154 are not absolute prohibitions to

the admissibility of settlement discussions which may contain information other than proving liability. These Evidence Code sections only prohibit the introduction of evidence for the purpose of proving liability for a claim.

Settlement Negotiations: Section 1152, subdivision (a), provides, “Evidenc

e that a person has, in compromise … furnished or offered or promised to furnish money or any other thing … to another who has sustained … loss or damage, as well as any conduct or statements made in negotiation thereof, is inadmissible to prove his or her liability for the loss or damage or any part of it.”

Recall that California Evidence Code Section 1152 excludes evidence of "any

conduct or statements made in negotiation" of settlement to prove liability against a party.

Confidentiality protection in settlement negotiations comes from Evidence Co

de Section 1152. Section 1152 states that evidence of a compromise or offer of compromise is inadmissible to prove liability for loss or damage. The protections of Section 1152 extend to conduct and statements made in negotiation of an offer.

The Legislature enacted Labor Code 65, and Evidence Code sections 1152, 1154

, and 1152.5, to promote and protect candid off-the-record settlement discussions. The choice to exclude evidence is always difficult and controversial. The protections in each of these sections were eventually eroded by later appellate court decisions.

In a nutshell, California Evidence Code §1119 works very much like Evidence

Code §1152, except that it was designed to deal with mediations. Evidence Code §1119(a) prohibits in court the use of any statement made for, in the course of, or pursuant to a mediation.
