A person commits an offense if, during a period that is 12 months or less in

duration, the person two or more times engages in conduct that constitutes an offense under Section 22.01 (Assault) (a) (1) against another person or persons whose relationship to or association with the defendant is described by Section 71.0021 (Dating Violence) (b), 71.003 (Family), or 71.005 (Household), Family Code.

Continuous Family Violence in Texas Texas Penal Code § 25.11 was created to

enhance the penalties to a third-degree felony when it is alleged that a person assaults one or more of his/her family members, household members, or a person with whom he/she has a dating relationship, two or more times within a 12 month period.

Texas Penal Code 21.02 lays out the elements for Continuous Sexual Assault o

f a Child. It’s important to point out that jurors do not have to agree that the same acts of sexual abuse occurred. The jury must unanimously agree that at least any two acts of sexual abuse alleged in the indictment occurred.

The Texas Penal Code clearly states the punishments for being convicted of c

ontinuous sexual abuse of a young child or children, saying: "An offense under this section is a felony of the first degree, punishable by imprisonment in the Texas Department of Criminal Justice for life, or for any term of not more than 99 years or less than 25 years."

As for penalties and punishments in Texas for continuous violence against th

e family, the crime is considered a third degree felony, which is less serious than a first degree felony, but still is a serious charge. Texas punishments for a third degree felony include a prison sentence of between 2 and 10 years, and a fine of up to $10,000.

“In his first issue, appellant argues the continuous sexual abuse statute,

penal code section 21.02, in unconstitutional on its face and as applied and resulted in fundamental error as applied in this case. However, appellant did not raise the issue of the constitutionality of section 21.02 in the trial court.

Legislators in Texas implemented harsh penalties for people charged with con
