nder simplified rules and to furnish to certain full-time employees a document other than the Form 1095-C.

In short, the Qualifying Offer Method was created to simplify the ACA report

ing process by allowing employers that offer exceptionally affordable coverage to shortcut some of the ACA reporting requirements.

A Qualifying Offer is an offer of coverage that satisfies all of the followi

ng criteria: An offer of Minimum Essential Coverage that provides Minimum Value. The employee cost for employee-only coverage for each month does not exceed 9.5% of the mainland single federal poverty line divided by 12.

The Qualifying Offer Method is essentially a reporting short-cut for those e

mployers that are offering affordable coverage to the majority of their full-time employees. If you offer health insurance coverage to at least 95% of your full-time employees, you may be eligible to utilize the Qualifying Offer Method, provided:

A. Qualifying Offer Method – the ALE Member can certify that it made a Qua

lifying Offer (affordable based on FPL and minimum value) to one or more of its full-time employees for all months during the year in which the employee was a full-time employee.

ALE Members that offer health coverage through an employer-sponsored, self-i

nsured health plan must complete Form 1095-C, Parts I, II, and III, for any employee who enrolls in the health coverage, whether or not the employee is a full-time employee for any month of the calendar year.

Qualifying Health Coverage Any health insurance that meets the Affordable Ca

re Act requirement for coverage. If you have qualifying health coverage (or “minimum essential coverage” or “MEC”) you don’t have to pay the penalty for being uninsured through the 2018 plan year.

The W-2 Safe Harbor is a method for proving ACA affordability that involves

the use of an employee’s W-2 Box 1, gross income. It can be the trickiest safe harbor to use because it cannot be determined until the end of the year. The reason for this is because you need the amount in the W-2 Box 1 for the affordability calculation.

A Qualifying Offer is an offer of MEC providing minimum value to one or more

full-time employees for all calendar months during the calendar year for which the employee was a full-time employee for whom a section 4980H assessable payment could apply, with an Employee Required Contribution for each month not exceeding 9.5 % (as adjusted) of the mainland single federal poverty line divided by 12, provided that the offer includes an offer of MEC to the employee’s spouse and dependents (if any).
